The gîte "Le Magnolia" is a charming house in the heart of a wine estate, fully renovated, air-conditioned, with a private garden, a few minutes from Saint-Émilion. These rental terms and conditions (hereinafter "the Conditions"), which also serve as house rules, govern any short-term rental of the gîte. The rental is managed by SCI EFICA, SIREN 453 451 411, registered with the French National Business Register (RNE), letting of accommodation (NAF 68.20A) — hereinafter "the Owner". Any booking implies full and unreserved acceptance of these Conditions by the tenant (hereinafter "the Tenant").
1. The accommodation
Gîte "Le Magnolia" — 59 impasse des Faure, 33330 Saint-Émilion, on the estate of Château Tour Grand Faurie. Maximum capacity: 4 people (sleeping arrangements: 160 × 200 bed on the ground floor, 140 × 200 bed upstairs). The accommodation is let furnished and equipped, for exclusive use as leisure accommodation.
The number of occupants may not exceed the maximum capacity stated, unless the Owner has given prior written consent. In the event of unauthorised over-occupancy, the Owner may refuse access to the accommodation or terminate the stay, with no compensation or refund.
2. Length of stay
- Low season: minimum stay of 2 nights.
- High season, from 1 July to 31 August: priority is given to weekly stays; minimum stay of 4 nights.
Under no circumstances may the Tenant claim any right to remain on the premises once the booked stay has ended.
3. Booking and payment
Bookings are made online at https://tourgrandfaurie.com/ or directly with the estate. Payment is made by bank card, via a secure payment platform.
The booking is definitively confirmed once:
- 100 % of the amount of the stay has been paid;
- these Conditions, which also serve as house rules, have been accepted;
- the information required for the rental agreement has been provided (identity, contact details, number and identity of the occupants);
- the security deposit has been paid or a card pre-authorisation has been taken, before entering the premises.
4. Prices and services
Rates are expressed in euros, all taxes included, per night and according to the season. The price of the stay covers the rental of the accommodation only.
The following are not included in the price and are added where applicable:
- the optional end-of-stay cleaning package: €80, to be taken out at the time of booking. If the package is not taken out, the accommodation must be returned clean and tidy, in the state of cleanliness observed on arrival;
- the tourist tax (article 5);
- the security deposit (article 6), which is not an additional charge but a refundable guarantee.
5. Tourist tax
The tourist tax, currently €4.60 per person per night, is collected on behalf of the local authority and paid together with the stay. Its amount is liable to change in accordance with the local authority's decision; the applicable amount is the one in force on the dates of the stay.
6. Security deposit
A security deposit is required before entering the premises, by card pre-authorisation or any other means agreed with the Owner:

The security deposit is returned (or the card pre-authorisation released) no later than 14 days after departure, less, on presentation of supporting documents, the cost of any damage, losses, or repair or cleaning costs made necessary. If the sums due exceed the security deposit, the Tenant undertakes to pay the balance on presentation of supporting documents.
7. Cancellation and modification
Any cancellation must be notified in writing (by e-mail to contact@tourgrandfaurie.com). The date of receipt of the notification shall be authoritative. The following sums remain due to the Owner:

The tourist tax and any cleaning package taken out are refunded for any stay cancelled before arrival. A shortened stay or a delayed arrival gives rise to no refund. Any request to change the dates will be considered sympathetically, subject to availability; failing agreement, the cancellation terms above shall apply. The Tenant is advised to take out cancellation insurance.
8. Check-in, check-out and inventory of fixtures
Check-in from 4 p.m., check-out no later than 10 a.m., unless otherwise agreed in advance. An inventory of fixtures and a list of contents are drawn up on arrival and on departure, jointly wherever possible. The Tenant must report any anomaly observed on arrival within 24 hours; failing this, the accommodation is deemed to be in accordance with the check-in inventory of fixtures.
9. Tenant's obligations
- Use the accommodation and its equipment peacefully, with respect for the neighbourhood and for the character of a working wine estate;
- The accommodation is non-smoking indoors;
- Parties, receptions and events are not permitted;
- Do not assign or sublet the accommodation;
- Report to the Owner without delay any incident, breakdown or damage occurring during the stay;
- Return the accommodation clean and tidy (unless the cleaning package has been taken out), and comply with the waste-sorting instructions.
10. Pets
Pets are not allowed, unless the Owner has given prior written consent. Where consent is given, the Tenant remains liable for any damage or nuisance caused by the animal.
11. Insurance
The Tenant declares that they hold public liability insurance covering holiday rental risks (fire, water damage, damage to the rented property). Proof of insurance may be requested before entering the premises.
12. Owner's liability
The Owner may not be held liable for the theft or loss of personal effects in the accommodation or on the estate, nor for interruptions to services (water, electricity, networks, internet access) beyond its control, nor for nuisances originating outside the estate. The Owner's liability may not be incurred in the event of abnormal use of the accommodation by the Tenant.
13. Cancellation by the Owner — force majeure
If the Owner is obliged to cancel the stay, in particular in the event of force majeure or of being unable to make the accommodation available under normal conditions, the Tenant is informed without delay and obtains a full refund of the sums paid, with no further compensation. The Owner will endeavour, as far as possible, to offer an alternative solution or a postponement.
14. No right of withdrawal
In accordance with Article L.221-28, 12° of the French Consumer Code, accommodation services provided on a specified date or for a specified period are not subject to the right of withdrawal. Only the cancellation terms set out in article 7 apply.
15. Personal data
The information collected at the time of booking is necessary for the management of the stay (rental agreement, tourist tax, security deposit) and is not used for any other purpose without consent. In accordance with the GDPR, the Tenant has a right of access to, rectification of and erasure of their data, which may be exercised by writing to contact@tourgrandfaurie.com. 16. Applicable law and disputes
These Conditions are governed by French law. In the event of any difficulty, the Tenant is invited to send a written complaint to the Owner, who will endeavour to respond as promptly as possible. In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Tenant may have free recourse to a consumer mediator; the contact details of the competent mediator are provided on request. Failing an amicable settlement, the dispute will be brought before the competent courts under the conditions laid down by the French Code of Civil Procedure.
